I get to spend every other weekend with them and 2 times a week we attempt to do homework and get a drink from 711 after. Since I live in East Northport and the children live in Port Washington, I do not get to spend a lot of time with them due to distance. The 45 mins each way was a struggle but after 8 years its become life. Thankfully the my home still holds me and the kids comfortably during their visits. I have not had the best of relationships with the mother of my children. I came to the courts to protect my kids. I filed for custody to provide safety for the kids and to gain legal rights as Cristina was controlling my time with the kids unfairly and making decisions that were not in the best interests of my kids in the past. Unfortunately, I was laid off Oct. 16. I filed the motion to adjust on nov.7 and the arrears were not forgiven by Cristina due to selfishness and anger towards myself. She has never cared about the relationship between me and the kids and has done less to facilitate it by refusing to pick or drop off the children ever other week. Telling me to “take it to court” since 2 years after we appeared in your court. Thankfully I started work on Dec. 16 in Syosset which is closer to the kids then my last job in Hauppauge! Gaining me time to spend with them and less on gas. My car is old, and I have lost time with my kids because of it. Cristina has not provided help or assistance during those times without a car. Cristina has lied to the courts repeatedly to take advantage of me with child care costs. I agree with the $660 biweekly as support. But I believe my 11 yo son does not need child care as his grandmother has been living with him for 4 years or more. Before that it was an aunt. Each time cristina claims to pay 200 a week for child care to them while other family members live rent free. I think it’s unfair that this happened and continues to occur as each time the family members were the ones she claimed to pay since 2020. My salary is less then before at 75k or $2,177.80 after taxes in my new job. I will have to cut expensise to survive especially when medical insurance kick in starting march at $400 a month. During my unemployment I kept up with the 2 times a week visits but couldn’t take the kids on the weekends since the extra food expense to feed and gas to pick and drop off both ways was too much to afford with only 189.00 a week in unemployment benefits. Cristina received $252 a week during that time. Starting with my next paycheck, cristina will get $660.66 child support + $55 child care + $409 arrears for a total of $1227 every check. Currently bi-weekly I make 2,177.80 after taxes. That leaves me with $950.80 till my next pay check. Monthly I will take home, at the current child support/care responsibility, is $1,901.6. Support will take over 50% of my take home pay and I can not live on that. Rent is $1450 after the latest increase. Gas is $400 monthly at least. Car insurance is $250 a month. Not counting food I fall short in my budget October 16 I was laid off December 16 I was hired at my current job making 75k/yr While on umemployment $280 was removed from check every week 2020 last time I was unemployed this happened, and the arrears were not dismissed as well Mother living at home which makes the living space too crowded for Cristina (MOM), my 2 kids, the other child from ex fiancé, and grandma in a 2 bedroom apartment 55/wk on child care for my 11 year old son? While mom is at home? Would like the support cases to be reviewed and cristina has done this same thing before with her aunt. Hasn’t since 9.   Subject: Petition for Contempt of Court - Child Visitation Violation Your Honor, I am writing to respectfully inform you of blatant violations of the existing child visitation order regarding my children, Isabella and Isaiah, by Cristina. As per the court order dated [Date of Order], Cristina and I agreed to trade off pick up and drop offs. However, Cristina has repeatedly refused to pick up or drop off the kids every other weekend, since the inception of the agreement. Specific instances of other violations: • Cristina has refused to pick up or drop off the kids as per the agreement for 5 years or more • The kids have a lot of unexcused missed days of school this year and in the past years due to various “illnesses”. I would like clarity on the missed school since I was not notified. • Her lies to the Court and myself have put the kids in danger. After stating that the police were called to the home several times, as I learned of for the first time in your court room, because of Cristina’s own behavior. It was her fiancé that was behaving negatively and endangering the children with his drinking. After splitting up with him and having him arrested for domestic violence, she then had him move her and the kids to the new apartment. Giving in him the new address to visit and causing stress on the children. • Cristina has repeatedly monitored the phone calls I have with the children. A specific instance is on Sept. 20, 2023. I asked her to stop and was met with anger. Text • Cristina, at the last minute, told me that Isabella would not be coming with me for my weekend. This occurred on Jul 20, 2023. Texts • Cristina at various times left me waiting outside for the kids for over 30 mins or missed them completely • Cristina has changed my weekend visitation with the kids many times last minute • Cristina never reported the raises in earnings she has gotten from her job • • [Optional: Include any instances where the child expressed distress or discomfort due to the visitation disruptions]. These repeated violations are significantly impacting my relationship with the kids and causing unnecessary emotional distress for both of us. I believe that Cristina's actions are in direct contempt of the court order and are not in the best interests of our children. Therefore, I respectfully request that the court: • Issue an order to show cause to Cristina to explain her noncompliance with the visitation schedule. • Consider sanctions against Cristina for violating the court order. • Modify the existing visitation order to include stricter enforcement mechanisms. • Provide me with information on what transpired with the ex-fiance and Cristina so I can understand what my children when through. • Enact a program to monitor the communication between Cristina and I as to avoid any further negative moments. • Provide clear instructions on US Govn passports possession policy and usage to travel • Dismiss arrears in full of approx. $2,290.18. $100 cash payments were not recorded as received even though cristina confirmed she got the Zelle transfers in court • Enforce pick up and drop off rule on alternate weekends • Cancel child care expenses and refund all payments done while family members lived in the house • Keep the childrens on the mothers health plan • Medical Decisions be made by a third party since Cristina and I do not agree. • Lift the restrictions on visitation with the kids • Provide a recent paystub to confirm wage Attached are copies of the existing court order, Further evidence can be provided such as: text messages documenting recent communication attempts, and various other items Thank you for your time and consideration.
