I need to state upfront, that I do not have funds for a lawyer due do Home Equity Bank’s breaking their covenant to me years ago. They promised me that I would have access to 50% of the equity in my home. THAT is the reason I took the decision to work with them. I did not have to go this route, but it seemed like a fast and easy solution that suited me, as my intention was to pay the loan down completely when my inheritance kicked in. I am a single, woman, never having been married due to outstanding circumstance and I have no children or husband. I am alone. I worked diligently for 17 years at Johnston and Daniel selling Luxury real estate beginning in the original office on Balliol and later moving to the bigger office at Mt Pleasant and Merton under the ownership and guidance of Jamie Gairdner. I left after 17 years and moved to London England to attain my Masters in Fine Art at Christie’s Fine Art in South Kensington. I worked for a while for Sotheby’s in London, and then came back to Canada to be closer to my ageing parents. I could no long continue to service my very special clients in the way that I had the past 20 years. I realized I had to make some changes. This would mean slowly closing my business. As a result of this, I would not have the funds to pay a monthly mortgage. It was time to pare down and focus on recovering from these devastating diseases that ended up with my being bedridden for 3 years, barely able to climb the stairs to my bedroom or drive my car. It was at this point, I was referred to Home Equity Bank. I felt comfortable there. An old friend from University’s sister was on their board at the time and her 1st cousins were very good friends with my parents. So – the decision was taken to go this route. I wanted to remain financially independent from my family. I discussed with them my plan, and my Dad offered at that time to pay off the RBC mortgage in full. I remained firm that I wanted to deal with my house, my way. I went forward and met with Chris Willenberg, from HEB, who I liked very much. He talked me through the process of how a reverse mortgage would benefit me, by eliminating monthly payments and the ability to tap into further funds when needed, up to 50% equity of the value of my home. Sounded like a good plan. This was a perfect situation for me, I thought Chris then referred me to a lawyer that was frequently used by Home Equity Bank – William Parker from Parker and Parker, over on Mount Pleasant. I reviewed the loan with that lawyer, Bill Parker that Home Equity Bank had referred me to and I signed the document. Everything went smoothly and I was happy with my decision and life continued. Then life turned unexpectedly upside down. My rock, my father passed away in October of 2018. It was a painful and devastating loss for me. It also caused a rift between my mother and I due to circumstances around my father’s death that I don’t need to discuss here – but suffice it to say, suddenly I became very alone. In 2019, I lost my precious puppy at age 14. It was a devastating loss on the heel of losing my Dad. I sadly had not children, and she was like my kid, as crazy as that may sound. And then I lost my precious brother, leaving behind two young children. Tin 2019 a builder purchased the other side of my semi-detached home. He never came to speak to me, and one morning myself and my 4 tenants woke up at 7 a.m. to excruciating noise. We white knuckled through this demolition and rebuild as the entire house was taken back to the studs and rebuilt. I begged them to consider the impact it was having on those of us on the other side of the wall. I couldn’t understand how this was being allowed. It was inhumane. Finally he completed the house and put it up for sale and he quickly found a new buyer. Problem was that the new buyer once again never came to speak to me and one day the banging began again. The new owner began a completely new demolition, as they did not like the framing the former builder did. This time it was worse. The demolition was happening during Covid when we were all locked in the home. The sound was regularly above 99 decibals and the vibrations were intense and ongoing. I had a conversation with the owner and he said he would discuss it with his builder. When he got back to me, he informed me that under Covid, the new building codes allowed construction from 7 a.m. until 10 p.m. and they planned to work on this schedule. He informed me this was his right and his home and he would do as he liked. At this point I called a lawyer to get a cease and desist until we could come to an agreement of some sort that worked for everyone. The lawyer insisted a cease and desist would not stop him and that we must sue him. I reluctantly went along with this plan, although it would not have been my choice. Also around this time, I learned that the owner next door was required to have a party wall permit – signed by me, to agree with any work done on the central shared wall. They forged my signature. I had not idea until months later when I was on a call with the city. The city revoked their permit – yet they carried on, ignoring the city’s stop work order. This time around, they took the decision to remove each and every floor joint in the house. These joists attach into our central brick wall that is shared. Each and every one of those huge floor joists needed to be drilled out. The noise was excruciating and we had nowhere to go, and it was Covid! Then a jackhammer came through the 3rd floor wall, right above my tenants bed, while he was lying in it, and raccoons had moved in to my third floor crawl space, as the builder had opened up the entire party wall now, unbeknownst to me and my home was open between the floor boards and wide open access to the third floor attic where the raccoons made their home and had their babies. Dust and no doubt asbestos was now infiltrating my home. Both of my tenants (4 of them) had no choice but to leave. It was an impossible, excruciating living condition. I was unable to re rent for two years due to Covid lock down and the obvious construction noise next door. I lost 2 years of rent and my savings during this period. I was now unable to pay for ANY bills, including property tax. I did not want to reach out to my family. I wished to continue to remain independent and I did not wish to give them stress at their age. I also knew in the back of my mind that I had access to over a million dollars in equity from Home Equity Bank to tap in to, so I called them. This is when things became strange. I called and spoke to someone and explained the situation. I was told, no worries, just fill out this form and it will be arranged. I did this and then waited and waited. I made a follow up call and was assured, it was just a delay, and to be patient. I call again, after a few months had passed, thinking they just must be very busy. I spoke to someone else. He was confused as to what had happened to my application. We spoke and he looked over my file and said, I see no problem, I will get this approved and you will hear back from me within a few days. Then more time goes by, weeks – and nothing. I call again – and I am told, your file was turned down. What in the world is going on? I was verbally approved twice over the phone and now, I am not approved. How is this even possible? I was promised 50% of the equity in my house and I’m nowhere even close to that. I called again and spoke to someone on the phone and explained I was under duress, I had lost my tenants and my income and know was involved with a lawsuit over impossible and inhuman living conditions. HEB asked for a copy of the lawsuit as proof, which I provided. I also provided proof that I was suffering Lyme and co infections and PTSD – due to the brutal murder of my best friend years earlier. Everything was very strange. 7 or 8 months had now passed since I first approached HEB for an extension of my loan and it never came through and I have never been given an explanation to this day. THIS IS NOT OKAY and they broke a very serious commitment to me when they refused to extend further funds to me. – Not a penny. Why? I would like that question answered. At this point things took an unpleasant turn. I was getting all kinds of different answers, so I reached out to the CEO of HEB directly, Steve Ranson for some explanation as to what was going on. He did not have the decency to reply to me. Instead, I get a legal letter from Dentons, threatening to put my house to power of sale because my taxes were not paid. HEB knew exactly why my taxes were not paid – I lost my income and my savings were used up in my litigation with the construction problem beside me. Where was HEB when I needed them? Why did they lie to me about further access to funds? Where is the transparency? So many questions. One day I called the main switchboard to try to speak to someone, and a lady named Patricia was so rude and told me, I don’t care if you pay your taxes or not, it is too late. You will loose your house. And then she slammed the phone done. I was shell shocked with her abrupt and poor social skills. So many red flags. What is going on at this “Bank”???? At this point, I reluctantly called my mother. I did not wish to involve her in such a disagreeable and unfortunate situation. She became livid and called HEB and had some words with someone. This time I got a call back, but it was just pleasant small talk with zero explanation as to what was really going on. The purpose in moving to Home Equity Bank was to eliminate any stress due to my health. Stress exasperates my condition, as it is neurological. My home is my security and my safe place and has been for the last almost 20 years. I had 2 tenanted apartments to help underwrite house costs. I live very modestly and I no longer have a car. All this due to HEB breaking their promise and commitment to me. They market themselves as this loving family who wish to help seniors live a better life. The truth is the exact opposite. They are in fact out to terrorize people and steal their homes. This is what they are attempting to do with me and in my view this is active CRIMINAL ACTIVITY. This week, I received a letter from them that the Judge who read my case said I have 8 days to vacate my home. This is completely OUTRAGEOUS. The lawyers for Dentons followed up by sending eviction notices to my four tenants telling them they too must leave this house in 8 days. This is not only completely unreasonable in is a crime. I am an almost 65 year old senior, with no funds, due to the lies and promises that were reneged on by HEB. I have Post Traumatic Stress Disorder and a chronic health issues I continue to fight back against. My home is my safe place. It would take me 2 to 3 months just to get things packed up in order to move. The land lord tenant act clearly states, tenants must be given a minimum of 60 day’s notice if they are being asked to move out. Yet, the Judge requires us all to leave with only 8 days notice. I am sickened and appalled at this decision. In is inhuman and unconscionable. I do not consent to leave my home. I deserve to be treated fairly and respectfully. I will state on the record that HEB did not fulfil their promises to further extend the 50% equity that was promised to me. Had I know this, what was my incentive to work with them? NONE I have been lied to mislead and treated with extreme disrespect. It is my strong belief that HEB has no contract with me, as they lied to me and broke their promise to me – and to this day, I have not been given any valid explanation as to why. Further more they have yet to produce the ORIGINAL CONTRACT that proves there is a valid contract. I already know the answer and I hope the esteemed Judge evaluates what I have shared here and takes everything here I have said into strong consideration. I hope to put an end to this harassment here today.
